1. The District court Summons is now called a&amp;nbsp;Claim Notice and is up to &amp;euro;15,000 in the local district court.
2.&amp;nbsp;LCMS/Solicitor retains the burden of administration which limits the input required by our&amp;nbsp;clients.
3.&amp;nbsp;Within 35 days&amp;nbsp;the&amp;nbsp;Claim Notice can be ready to be served on the debtor.
4.In an undefended case an automatic Court Judgement is obtained and can be registered.&amp;nbsp;&amp;nbsp;
5. If defended exact reasons why the debt is not owed has to be outlined by the debtor on receipt of Claim Notice. A court date has then to be obtained.
6. Legal letters are generally sent out to debtors on a &quot;no collection no fee&quot; basis on accounts of all values in association with our legal partners.&amp;nbsp;
7.&amp;nbsp;It can be cost effective for a debt greater than &amp;euro;500 to progress to the Claim Notice.

    <description>One of the not so fun facts of being in business is the soul-destroying fact that some people will try not to pay you. No matter what industry you are in, if you give credit, you run the chance of not being paid.
In 2015 the rate of consumer debt was up, there were 1692 consumer judgements in the courts for the first 6 months of 2015, that was a 6 per cent rise on 2014 and the figure keeps rising.
However the news is not all bad, in the same time period, there was an evident fall in the value of commercial judgements, 25% compared with 2014. The figures are now one third of what they were in the period of mid recession 2009, this has to be good news.
We all know the problems that your customers not paying you, can cause you in the day to day running of your business. When it comes to the crux of the matter, if you don&amp;rsquo;t get paid, you can&amp;rsquo;t pay your suppliers, therefore you cannot stock your shelves, cannot increase sales of products and therefore sales fall, turnover falls and it&amp;rsquo;s a downward spiral.
If you make one New Years resolution and stick to it, make it this one:
&amp;lsquo;To engage proactive credit control practises&amp;rsquo;

    <description>Have you bought stock and sold it on but not been paid for it yet or have you done a job for someone and they refuse to send you on a payment?
At LCMS, we understand the frustration and difficulties that arise when people do not pay you.&amp;nbsp; Perhaps you need to use the monies due to pay your own bills, buy equipment or even pay the staff wages.&amp;nbsp; 
We understand the frustration when a debtor promises payment and does not carry through.&amp;nbsp; Our clients often need the money to pay someone else and if the debtor reneges on the agreement, it places our clients in a difficult position. With our processes, a debt will either be fully paid, partially paid or ready to proceed to legal within 35 days.&amp;nbsp; 
Likewise, there is nothing more stressful than wondering how you are going to pay someone that you owe money to.&amp;nbsp; We work closely with debtors to facilitate payment, set up payment plans or ring at prearranged times to take regular payments from their debit card.&amp;nbsp; 
We understand that debtors may owe numerous people or businesses money and find it difficult to find a solution to their financial muddle.&amp;nbsp; Our collections staff are all trained to recognise vulnerable debtors and we have a vulnerable debtor plan to assist people sympathetically. 
When a company engages LCMS to collect in overdue accounts, we create an account for them on our online portal.&amp;nbsp; They can load a debtor along with their debts.&amp;nbsp; A letter is sent to the debtor, informing them that the debt has been referred to a third party and to encourage them to resolve the situation.&amp;nbsp; We also give them a ring, often the debt is paid via debit card on the first phone call.&amp;nbsp; This call also gives us an opportunity to address any issues that remain unsorted, such as credit note due or unrecorded payment. We liaise with our clients&amp;rsquo; accounts receivable team to sort any queries and refer back to the debtors. Second letters and phone calls are also made before we organise Solicitors letters and calls for you, using our panel of experienced Solicitors and our legal team.     <description>What a busy week we have had in LCMS.&amp;nbsp; The week started off with the four new staff joining us on Monday to get settled in and start training in the services that we provide for our clients.&amp;nbsp; I am one of the new recruits and have moved to LCMS as the Sales and Marketing Manager to inform businesses throughout Ireland of the many services that LCMS provide.&amp;nbsp; Having previously been involved in business for the last 14 years and providing book keeping services to businesses, I know all about the problems caused by lack of cash flow into a business. &amp;nbsp;Having had the privilege of working with the North Kildare Chamber for the last 16 months, I have worked closely with many Kildare based businesses and look forward to continuing to do so.
I sat with the credit collection team, listening to the team calling on behalf of clients to collect payments for them.&amp;nbsp; On hearing the overdue accounts being settled by credit card or promise of transfers or cheque payments, it struck me that while business owners are out doing what they went into business to do, the LCMS team were doing what they do so well, increasing cash flow their clients and decreasing debtors listings.&amp;nbsp; I could have done with the service myself years ago when I was the sales team, the marketer, the HR expert, the accountant and the tea maker, all at once!&amp;nbsp; &amp;nbsp;The highly skilled team take care of that major headache, credit control, while maintaining a very positive relationship with the companies&amp;rsquo; clients.&amp;nbsp; If I had engaged the services of LCMS then, where would my business be now?&amp;nbsp; Still in existence I think.
I met many fantastic businesses in my first week, many whom I hope to work very closely with for a long time.&amp;nbsp; The Wednesday morning networking meeting in the North Kildare Chamber office brings extremely proactive business owners together to network, support and learn from each other.&amp;nbsp; The feeling of comradery is huge and you know that the other networkers genuinely want your business to succeed.&amp;nbsp; If you need a service and it&amp;rsquo;s not represented in the room, you can be sure someone can point you in the right direction. 
We also took to the road to Wexford to the Wexford Chamber Business Expo and again I was blown away by the quality and variety of companies represented.&amp;nbsp; There was a tremendous energy in the room and lots of swapping of cards.&amp;nbsp; We made some great contacts and I look forward to travelling to Wexford regularly to meet with our Wexford based clients.&amp;nbsp; We also have an office in Gorey and two account managers based in Wexford so there is lots of support for our clients down in the sunny south east.&amp;nbsp; 
Next week is a busy one including lots more networking, Women in Business with Kildare and Meath Local Enterprise Offices on Monday evening in the beautiful Carton House &amp;nbsp;Hotel, Naas on Wednesday and I am going along to another networking on Thursday morning so I should have my 60 second pitch down pat by then.&amp;nbsp; If you are not a member of your local chamber, I would strongly recommend you check them out, the networking is only part of the chamber experience, wait for the awards night, now there&amp;rsquo;s a party!

Have you ever been in the situation where you&amp;rsquo;re sat in your office wondering &amp;lsquo;where is all my money going?&amp;rsquo; It started off great; you had a plan, a team and the funding to start your own business, but now six months down the line your cashflow is starting to struggle. What can you do? Does everyone starting their own business go through this? The answer is probably yes. Most new businesses take time to find their feet and get into the flow of running their own business, so take a deep breath and stay positive.  There are good and bad points when you first start off and throughout the running of your business for that matter, however there are some things you can do to try to get your cashflow on the healthy track.
The first thing you need to ensure is that you are getting paid, consistently and in the full amount. As cash is king this may be an obvious priority for a business, but so many businesses go unpaid for long periods of time, meaning they lose out on massive amounts of money and allow their cashflow to be severely disrupted. There was &amp;pound;12,567,889,275 worth of debt in the UK last year alone, so keep on top of your finances and make sure more money is coming in than going out if you want to make a profit. Your cashflow should be your main priority in terms of running your business, you need to protect and nourish it. Many businesses hesitate to enforce a cash collection service or get legal advice when owed money, but if you are having continuous trouble with certain customers who are refusing to pay you, there are various options available to you. You can use a cash collection company or appoint a solicitor to chase your debt for you, or you could do it yourself starting with debt chasing letters. So if you need a bit of guidance, you can choose from a range of different templates and control how often the letters are sent out.
Now that you have taken care of the money coming in, maybe now is a good time to monitor what is going out. There will always be out goings for a business, even if it&amp;rsquo;s just for the office alone. Bills will always need to be paid to keep the business going, but you can control these to an extent. If your cashflow is struggling and you find yourself with less money that you would like at the end of the month; cut back on luxuries.  For example, if you have an office in the most expensive part of town, move to a cheaper location. Or if you are paying out for all the latest equipment and software for your office, you could downgrade if it&amp;rsquo;s not essential to your business. The biggest tip we could give is to live below your means when a business is struggling with cashflow.
Once you have established where you could potentially be losing money, it&amp;rsquo;s time to build it back up. Hiring the right people and having the right team around you could double your sales if done correctly. Take your time when hiring. Hiring managers have admitted that one in five of their team shouldn&amp;rsquo;t have been hired in the first place- so don&amp;rsquo;t rush into it. Spend some time figuring out the role you are searching for, and what that role entails. Think of the kind of person you want and what qualifications you want them to have. Be very specific in your job advert, and be picky in interviews. Make sure you choose people who will care about your business and work to the standards you expect.
Once you have consistent money coming in, controlled money going out and the right team behind you, you can then focus all your efforts on to getting the right business. Doing business with a company that will consistently pay you and not cause you any trouble is arguably hard to find. Credit checking is a very secure way to check that a business is creditworthy enough to do business with. A Creditsafe credit report will give you an over-all score of 0-100 of creditworthiness; taking into account their whole credit report. It will also offer you the company&amp;rsquo;s credit limit, director information, key financials and any adverse CCJ information. Choose to check the summary page and have all the key details of the report grouped together for you or alternatively you can delve right into the report and check their financial report going back over the previous five years. Always credit check potential customers before approaching them to do business; either find them yourself or use Creditsafe&amp;rsquo;s Marketing Prospects which gives you a previously vetted checked lists of potential customers.
